Zusammenfassung (übersetzt):
Indigenous peoples of different ethnic groups have occupied areas of Brazilian territory since a period before the Brazilian State. On numerous occasions, these peoples were forced to withdraw from areas they occupied. For these reasons, the Statute of the Indigenous and the Federal Constitution of 1988 assured them the right to the occupied lands and the usufruct of the resources. However, these rights have been attacked by legislative initiatives. The purpose of this article is to analyze these proposals and verify to what extent they affect constitutionally guaranteed indigenous rights. For this, a documental analysis was carried out. The results indicate that these initiatives could have serious consequences for indigenous peoples and the natural resources located on their lands.
