Public-private partnership (PPP) contracts are frequently used in the provision of public services. One of the key points to consider in these contracts (and from which much of its convenience derives) is the allocation of risks to the party that has the best capacity to avoid them or, if they occur, mitigate them. This paper analyzes the distribution of risks in public-private partnership (PPP) contracts applied to the water and sanitation services concession in seven Latin American cities. Based on the analysis carried out, a series of recommendations are proposed to improve future PPP contracts in relation to the distribution of risks between the parties, such as providing for a direct and agile dispute resolution mechanism; establish the classification, identification and assignment of risks, indicating the criteria that will be applied to determine their occurrence and the mechanisms by which the party that supports them will take charge of them and include special provisions for the case of public opposition risk to the project.
